President Donald Trump may begin to terminate the education department through an executive order, but he will need Congress approval to officially abolish the agency.
According to a White House fact sheet reported by Fox News Digital, Trump is expected to sign an order to dissolve the department in an attempt to educate families instead of bureaucracy.
If Trump signs such an order, as it is expected with Thursday, he can significantly reduce the department. However, the entire agency cannot be completely abolished unless the Congress legislates that resolve the laws of the department.
The Department of Education was set up in 1979 after the Congress approved the Act of the Education Department, in which former President Jimmy Carter was signed in the law. Republicans, including former President Ronald Reagan, have been spent for decades when the department has been demanded to end in an attempt to allow the department to determine educational decisions at the state and local level.

According to a lawyer and law professor, Andrew Stoltman, to approve any legislation, Trump will need Congress approval from a super -security security in Congress.
“President Trump does not have the ability to terminate a federal department,” Stoltman told Fox News Digital. “So, even if Trump can follow his words, he will have to pull some Democrats in the Senate, and it will be impossible.”

Jamie E. Wright, a founder of a political pundit and a right law firm, also told Fox News Digital that such bills could be obstructed.
“To successfully transfer such a bill to the law, Congress members will need to move forward easily through the legislative process for the president’s agenda – an attempt that can present obstacles, should be created by the legislators who consider the education of the department to educate the education department.
Trump has promised since his 2024 presidential campaign that he will work to shut down the department during his second term, and tapped Secretary Education Linda McMemon and head the agency to “keep himself out of his job” to lead the agency.
During his confirmation hearing in February, McMemon acknowledged that the administration would need Congress approval to move forward with the measures to eliminate the agency.
“Certainly, President Trump thinks we will work with the Congress,” McMemon told members of the Senate health, education, labor and pension committee. “We want to do this right. We want to make sure we are offering a plan that I think our senators can ride with it, and our Congress can join it, it will have a better working department, but it certainly needs Congress action.”
The administration has already taken steps to gut the department, starting to launch hundreds of millions of dollars of grant funding diversity, equity and joining schools and reducing its manpower.

Swanna New House, a spokesman for the Education Department, earlier told Fox News about digital that “President Trump’s goal is to reduce the Federal Bureaucracy and return the education authority in the states as dollars and decision -making should be close to students.”
The department currently monitors some funds, manages students’ loans, manages financial support, and implementing nunds creamy policies in schools, while most of the education itself is dealt with at the state level.
“Despite misunderstandings, the education department does not control the school curriculum, decides the salaries of the teachers, which is eligible for students’ aid and works to work as a primary source of funding for schools, run schools, or work,” the New House added.
