Miss Riley, 22, was found dead in a wooded area of the University of Georgia campus in February 2024 after she did not return from a morning run.
Her killer was arrested twice, in New York and Georgia, months before the murder, but was released before trial.
But the Raleigh Act passed the Republican-led House last year, but was not taken up in the Democratic-controlled Senate at the time.
It passed with bipartisan support on Wednesday as the balance of power in the Senate shifted to Republican control.
The bill calls for the Department of Homeland Security to detain immigrants if they are charged with theft, shoplifting, theft, assault against law enforcement or any crime that results in deportation. Includes “death or serious bodily injury to another person.”
It also gives states’ attorneys general the power to sue the federal government if their residents feel they have been harmed by national immigration policies.
The bill does not come with new funding for immigration control measures, which has led to criticism from Democrats that it would be too expensive to fully implement.
The Liberal Democrats criticized the bill as an unfair crackdown on suspects who have not yet been found guilty of a specific crime.
But the bill caused a split in the party, with some members voting in favor of the move, calling it common sense.
