Lawyers stage protests in Islamabad as JCP moot set to choose 8 SC judges – Pakistan

Since there will be a meeting of the Judicial Commission (JCP) today (Monday) to finalize the names of the eight judges of the Supreme Court, lawyers in Islamabad protested, and demanded that the meeting be postponed.

The JCP meeting has come between the opposition presented by the four Apex Court judges and the recent judges have also been transferred to the Islamabad High Court (IHC), which was opposed by five IHC judges. –

The JCP, which approves judicial appointments, will finalize appointments for eight empty SC positions. Under the 26th Constitutional Amendment, the Commission was re -formed to include four members of Parliament.

Initially, the IHC sent the names of three judges – Chief Justice Aamir Farooq, Justice Mohsin Akhtar Kayani and Justice Miangol Hassan Aurangzeb – JCP to Justice Tariq Mehmood Jehangiri and Babar Sattar by less than five years of service. Did not meet the need.

According to the representation presented by the judges, a judge takes an oath for the High Court in which he is appointed. He further emphasized that according to the constitutional intention, a judge will have to take a new oath when he moves to another High Court.

Based on this principle, the judge’s seniority in another High Court should determine the date of his new oath.

Four SC judges raised similar concerns last week and they want to postpone the JCP session today unless there is a decision on petitions against the 26th Amendment.

In his letter, Senior Pass Judge Justice Syed Mansoor Ali Shah, Justice Muneeb Akhtar, Justice Aisha A. Malik and Justice Episode Mannala had said that in the current situation, the only viable solution and option to save the dignity of the court. The sitting is to be postponed. .

Opposition PTI also called on CJP Afridi in a letter to postpone the commission meeting yesterday. The letter was written by Senator Ali Zafar, who represents PTI in the JCP with party chairman Barrister Gohar Ali Khan.
