26th Constitutional Amendment based on ‘one letter’: IHC judge Kayani – Pakistan

Islamabad High Court (IHC) Senior Possan Judge Justice Mohsin Akhtar Kayani said on Tuesday that the 26th Constitutional Amendment – which made several changes to the judiciary – was based on “a letter”.

Addressing the IHC Bar Association today, the judge praised the efforts of Islamabad’s bar and lawyer agencies to protect his rights and the rights of the nation.

“With the correct interpretation and implementation of the law, you can see Pakistan on the destination of development. For this, legal changes, even if this is the 26th constitutional amendment, you cannot refrain from your goals.

“Such stages continue to come into the history of Pakistan but consider that a letter has changed the entire system in Pakistan. I do not need to mention it but you are all witnesses that the 26th Constitutional Amendment. Based on a letter.

“To what extent is it intact? I hope that the entire bench of the Supreme Court will finally listen to it and this problem will be resolved for the people of Pakistan and for the sake of this country.

The judge said that the audience was part of the same system that faced numerous problems such as attacks on missing persons and personal freedoms that everyone appeared.

Nevertheless, he said that the above mentioned resolution was necessary and it is hoped that the legal community will play its role which requires direct lawyers, judges and media personnel.

Talking about the Islamabad bars complexes, he said: “The federal government and the Ministry of Law need to pay attention to the fact that where they make such changes in the law, they are immediately in the construction of the building. Should participate and hope that no one needs to write a letter for it.

The judge did not specify what letter he was referring to. However, he was one of the six IHC judges who wrote a shocking letter to members of the Supreme Judicial Council (SJC) in March last year, about which the judges were abducted and tortured their relatives. As well as efforts to put pressure through secret surveillance inside your homes.

Subsequently, calls came from various constituencies to investigate the investigation, among the former Chief Justice of Pakistan Qazi Phase Isa called for a full court meeting of the judges of the Supreme Court.

However, any action on the letter is still pending. In November, the SJC considered various powers about the letter and agreed to extend the consultation, noting that the judges’ code of conduct applied to various institutions as well as the heads of the judges.

Meanwhile, Constitution (Sixth Amendment) Act, 2024 It has become a law in October last year. It is a legislature that snatched 100 Moto Powers of the Supreme Court, set the term of the Chief Justice of Pakistan (CJP) in three years and empowered the Prime Minister to the next c. Appoint JP as one of the three senior SC judges. .

The amendment was criticized for rush, with which it was approved. The Faqiya International Court endorsed the “blow to judicial freedom” when the 26th Amendment signed the law.

Since then, questions have been raised on the jurisdiction of the Supreme Court judge, demanding a bench of a full court to raise appeals against the constitutional amendment and decide the matter.
